General Terms and Conditions for Online Sales

The present conditions of sale are concluded on the one hand by the organisation Géopolitique Africaine whose headquarters are situate at 165, Boulevard Haussmann 75008 Paris registered at the  prefecture under the company registration number W751205325 n° Siret 524 858 412 00017

Hereafter referred to as “the Publisher”

and on the other hand, by any natural person or legal entity wishing to conduct a search or make a purchase via the Internet site www.african-geopolitics.com 

Hereafter referred to as “the Buyer”.

Object

The present conditions of sale aim to define the contractual relations between the Publisher and the Buyer and the conditions applicable to any search or purchase through the Publisher’s Géopolitique Africaine site, whether the buyer is a professional or a consumer.
Searching, purchasing a hard copy journal or subscribing via this site imply an unreserved acceptance of the present conditions of sale by the Buyer.
These conditions of sale shall prevail over any other general or specific terms or conditions not specifically approved by the Publisher.
The Publisher may amend these conditions of sale at any time. In such a case, the conditions applicable shall be those in force at the date of the order by the Buyer.

Details of the proposed goods and services

The goods and services offered are those which appear in the catalogue published on the Publisher’s site.
These proposed goods and services will be available in 2 forms:
* Unlimited access to the latest journal
To obtain this, the Buyer must open an account on the site that will give him unlimited free access to the full set of articles from the latest journal.

* Unlimited access and downloading of all journals on the site
To obtain this, the Buyer must either purchase a journal or take out a paid subscription for a hard copy publication that will give him unlimited access and downloading of the set of articles of all the available journals on the site.

Type of offers

There are 3 types of offers:

- Subscribe to the magazine
This subscription allows to receive 4 times a year the quarterly magazine. The Publisher grants to the subscriber the authorization to consult the contents of all the accessible on-line magazines on his site. "

- Digital Subscription
This subscription allows to consult the contents of all the accessible on-line magazines on the site.

- Hard copy issue sales
The Buyer may purchase earlier publications of the hard copy journal. This offer will make it possible to search and download the contents of all the online journals accessible on the site.

In the event of the purchase of several earlier hard copy issues, the Buyer will benefit from a discount depending on the quantities:
- 2 to 4
- 5 to 9.

Beyond this, the Buyer must contact us for a quotation.


Activation of the account

Having opened a free account, subscribed to a paid hard copy or having purchased one/or more earlier hard copy issues, the Buyer will receive an account activation email. The registration will be validated once the activation link sent to the Buyer via email has been clicked.

Duration and renewal

The subscription is taken out for a period of one year and shall come into effect from the date of validation of the online purchase order by bank card or from the date of validation of the form, in the case of an offline payment (cheque or transfer).
Renewal is not automatic; it shall be the subject of an express agreement of the client.

Rights

The Publisher authorises the Buyer, having opened an account, to browse the articles of the latest journal online. Likewise, the Publisher authorises the Buyer of a hard copy subscription or a hard copy issue, to browse all the articles of journals available on the site, but also grants permission to download the contents of the publications accessible on its site.
This authorisation grants the Buyer a non-collective and non-exclusive right of private use on the information consulted, for which he would have paid for through a hard copy subscription or the purchase of an issue. This authorisation includes the right to reproduce for storage for purposes of on-screen viewing, in one copy, for backup copies or prints, on condition that the copies are strictly limited to the Buyer’s personal use.

Any networking is strictly forbidden.
 
This right is individual and is reserved for the exclusive and non-collective use of the subscriber and is not transferrable.
 
The Buyer of the hard copy subscription or the hard copy issue shall have no ownership whatsoever of the distributed documents. He may neither pass these on to third parties free of charge, nor market them directly or indirectly, nor redistribute them in any form whatsoever, even if only partially.

Any use other than that granted by the present general terms and conditions of sale shall be subject to the prior and express approval of the Publisher.

Liability

The Publisher cannot be held responsible for the reliability of the transmission of data on its site, the access time, as well as for any other technical aspect specifically linked to the Internet.
In particular, the Publisher shall not be held liable for any possible crashes and maintenance interventions required for the efficient running of its Internet site. 

Rates

The prices listed in the catalogue are Euro tax inclusive prices taking into account the VAT applicable on the day of the order; any change in the rate can be passed on to the price of the goods or services.
The Publisher reserves the right to amend the prices at any time; it however being agreed that the price appearing in the catalogue on the day of the order will be the only price applicable to the Buyer.
The prices indicated include the order processing costs.

The transport and delivery costs are indicated separately according to 3 geographic areas indicated below.
- Zone 1 : France (1,,25 Euros/journal)
- Zone 2 : European Union and Switzerland (1,5 Euros/journal)
- Zone 3 : Other (the rest of the world, 1,75 Euros/journal)

Orders

The Buyer, who wishes to purchase a hard copy journal or a subscription service, is required to:
–  complete the identification form in which he will indicate all the information required or provide his client number if such exists;
–  validate his order after having verified it;
–  make payment under the conditions provided for;
–  confirm his order and his payment.
The confirmation of the order will mean the acceptance of the present conditions of sale, the acknowledgment of having full awareness of these conditions and renouncing the exercise of the Buyer’s own conditions of purchase or any other conditions.
The information provided and the confirmation noted shall serve as proof of the transaction. The confirmation shall serve as the signature and acceptance of the operations carried out.
The Publisher will confirm the recorded order by email.

Cancellation

The Buyers (non professional natural persons), shall benefit from a cancellation period of seven days from the date of delivery of their order to return their product to the Publisher for exchange or for reimbursement without penalty, with the exception of the re-stocking charges.

Methods of payment

The price is payable on demand.
3 methods of payment:
* By bank card:
Payments will be made by CB bank card, Visa, Eurocard, MasterCard, Paypal; they will be effected through the secure PAYPAL system which uses the SSL (Secure Socket Layer) protocol in such a way that the information transmitted is encrypted by software and that no third parties are able to gain access to such information during transfer on the network.
The card will be debited at the time of the order.

The Buyer recognises that the communication of information concerning his bank card serves as authorisation to debit his bank account for the benefit of the Publisher up to a limit of the total amount of his order, VAT and costs included.
An acknowledgement of receipt is immediately sent to the Buyer via email.
* Payment by cheque in Euros:
The Buyer completes a form enabling his order to be recorded. He will receive a 1st email to the address indicated in his form, stating that his order has been taken into account pending his cheque. Next, the Buyer will receive a 2nd email confirming the delivery, from the date of receipt of the cheque.
If, within a period of 30 days from the date of access to the service, the Publisher has not received payment from the Buyer, the first mentioned has the right to suspend access to the service linked to the subscription or purchase of the service.
* Payment by bank transfer, administrative mandate or post:
The Buyer completes a form enabling his order to be recorded. He will receive a 1st email sent to the address indicated in his form, stating that his order has been taken into account, pending his transfer.
 
Next, the Buyer will receive a 2nd email confirming the delivery, from the date of receipt of the transfer.

If, within a period of 30 days from the date of access to the service, the Publisher has not received payment from the Buyer, the first mentioned has the right to suspend access to the service linked to the subscription.
The Buyer will have the option on his account to download or print an invoice reflecting the VAT amount.

Deliveries

Deliveries will be made to the address indicated in the purchase order and can only be carried out in the stipulated geographic zone.
From the time the journal leaves the premises of the Publisher, all risks shall be the responsibility of the Buyer. In the event of damage sustained during transport, a justified complaint must be submitted to the forwarding agent within three days from the date of delivery.
The delivery lead times are given as an indication only; if these exceed thirty days from the order date, the sales contract may be cancelled and the Buyer reimbursed.

Guarantee

All products supplied by the seller will benefit from a legal guarantee provided for by articles 1641 and following of the civil code.
In case of nonconformity of a journal sold, this may be returned to the Publisher who will receive such journal, exchange it or reimburse the Buyer for it.
All claims, requests for exchange or reimbursement must be done via the Internet to the following email address: claims@africain-geopolitics.com within thirty days from the date of delivery.

Liability

In the online sale process, the Publisher is bound by a performance obligation only; his liability cannot be engaged for damage resulting from the use of the Internet network such as loss of data, intrusion, virus, service ruptures, or other involuntary problems.

Intellectual property

All the elements on Géopolitique Africaine’s site are and shall remain the intellectual and exclusive property of the Publisher.
No person may copy, exploit, redistribute or use in any way whatsoever, even partially, the elements of the site whether software, visual or sound elements.
Any simple or hypertext links are strictly prohibited without the prior express written agreement of the Publisher.

Personal information

In accordance with the law of 6 January 1978 relative to information technology, computer files and freedoms, the nominative information concerning buyers may be automatically processed.
The Publisher reserves the right to collect information on the buyers, therein included through the use of cookies and, if it so wishes, to pass on the information collected to its business partners.
The Buyer may oppose the disclosure of his details by notifying the Publisher. Likewise, users have the right to access and rectify information concerning them, in accordance with the law of 6 January 1978.
The automatic processing of information, including the management of email addresses of users of the site, shall form part of a declaration to the CNIL (board which enforces data protection legislation) registered under number PY20075869U (in the process of declaration).

Filing - Proof

The Publisher will file all the purchase orders and invoices on a reliable and durable storage medium which will constitute a true copy in accordance with the provisions of article 1348 of the civil code.
The Publisher’s computerised record will be considered by the parties as proof of the communication, orders, payments and transactions that took place between the parties.
Settlement of disputes
The present conditions of online sales are subject to French law.
In the event of litigation, jurisdiction shall be given to the competent courts of Paris, notwithstanding plurality of defendants or the introduction of third parties.
